Terms of Service

These terms of service ("Terms") govern your use of the tutoring services provided by Think Smart Academy ("we", "us", "our") and our website at www.thinksmartacademy.co.uk. By booking a session, enrolling a student, or using our website, you agree to these Terms.

1. About Us

Think Smart Academy provides in-centre tutoring services for students from Key Stage 2 through to A-Level at our centres in Slough and High Wycombe. References to "you" and "your" mean the parent, guardian, or individual booking our services.

2. Booking and Enrolment

  • Bookings can be made through our website, by phone (01753 531 818), via WhatsApp, or in person at one of our centres.
  • A free trial session is available to new students with no obligation to enrol.
  • Enrolment is confirmed once you have completed our registration process and agreed to these Terms.
  • We reserve the right to refuse or cancel a booking at our discretion, for example if a session is fully booked or if we cannot appropriately meet a student's needs.
  • Places are allocated on a first-come, first-served basis. We maintain waiting lists for fully booked sessions.

3. Fees and Payment

  • Our current fees are published on our pricing page and may be updated from time to time.
  • Payment is due in advance, either monthly or per term, depending on your chosen plan.
  • We accept payment by bank transfer, card payment, or other methods as communicated at the time of enrolment.
  • If payment is not received by the due date, we may suspend the student's sessions until the outstanding balance is cleared.
  • All fees are quoted in GBP and are inclusive of VAT where applicable.

4. Cancellation and Refunds

a) Cancellation by you

  • You may cancel your enrolment by giving us at least 4 weeks' written notice (by email to [email protected]).
  • Fees paid in advance for sessions after the notice period will be refunded.
  • Missed sessions without prior notice are not eligible for a refund or credit. We ask for at least 24 hours' notice if your child cannot attend a scheduled session.
  • Where reasonable notice is given (24+ hours), we will offer a make-up session where availability allows. Make-up sessions are not guaranteed.

b) Cancellation by us

  • We may cancel or reschedule sessions due to circumstances beyond our control, including tutor illness, adverse weather, or building closures. In such cases, we will offer an alternative session or a pro-rata refund.
  • We reserve the right to terminate a student's enrolment if their behaviour is disruptive, unsafe, or in breach of our centre rules, after reasonable efforts to resolve the issue.

c) Cooling-off period

If you enrol online or at a distance, you have a 14-day cooling-off period under the Consumer Contracts Regulations 2013. If you wish to cancel within this period and no services have been provided, you will receive a full refund. If sessions have already started, a pro-rata deduction will apply.

5. Our Obligations

  • We will deliver tutoring services with reasonable care and skill, using qualified and DBS-checked tutors.
  • We will provide a safe, clean, and supportive learning environment at our centres.
  • We will keep you informed of your child's progress through regular updates and reports.
  • We will handle personal data in accordance with our Privacy Policy and UK GDPR.

6. Your Obligations

  • Ensure your child attends sessions on time and is collected promptly at the end of their session.
  • Inform us of any medical conditions, learning needs, or other relevant information that may affect your child's participation.
  • Notify us promptly of any changes to your contact details.
  • Ensure all fees are paid on time.
  • Treat our staff, tutors, and other students with respect.

7. Limitation of Liability

  • We do not guarantee specific academic outcomes, grades, or school placements. Our role is to provide expert support and resources to help your child reach their potential.
  • Our total liability to you for any claim arising from our services is limited to the fees you have paid for the relevant term or month.
  • We are not liable for any indirect, consequential, or incidental losses.
  • Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be excluded by law.

8. Intellectual Property

  • All teaching materials, worksheets, assessments, lesson plans, and content provided by Think Smart Academy remain our intellectual property.
  • Materials are provided for the personal, educational use of the enrolled student only and must not be copied, shared, distributed, or used for commercial purposes without our written consent.
  • Our website content, branding, and logo are protected by copyright and trademark laws.

9. Safeguarding

We take our safeguarding responsibilities seriously. All tutors hold enhanced DBS certificates, and our staff receive annual safeguarding training. We follow government guidelines on child protection and have designated Safeguarding Leads at each centre. For more information, please contact us directly.

10. Complaints and Disputes

  • If you have a complaint about our services, please contact us at [email protected] or speak to a centre manager.
  • We will acknowledge your complaint within 5 working days and aim to resolve it within 20 working days.
  • If we cannot resolve a dispute informally, both parties agree to attempt mediation before pursuing legal proceedings.

11. Governing Law

These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.

12. Changes to These Terms

We may update these Terms from time to time. Any material changes will be communicated to enrolled families by email. Continued use of our services after changes have been communicated constitutes acceptance of the updated Terms.
